Terms of Service

These terms are an agreement between — ("Merkuva"), —, and the person or legal entity that signs up at https://app.merkuva.com ("Member"). The Turkish version is the binding one; this translation is provided for convenience.

1. The service

Merkuva is a software service that lets members manage messages, build automation flows and use AI tools on channels such as Instagram and WhatsApp. Channel features are limited to what the channel providers' APIs offer and may change when those providers change their rules.

2. Accounts

You must be at least 18 and provide accurate information. If you sign up for a legal entity, you confirm that you are authorized to represent it. You are responsible for keeping your account secure.

3. Your obligations

• Use the platform in compliance with applicable law, including Turkish data protection law (KVKK) and electronic commerce law (Law No. 6563).
• Comply with the terms and policies of the channels you connect, including Meta Platform Terms, Instagram Community Guidelines and WhatsApp Business policies.
• Obtain the consents required to send commercial messages to your end users.
• Do not send spam, misleading or unlawful content, or attempt to compromise the platform.

For end-user data processed through your channels, you are the data controller and we act as your data processor under the Data Processing Agreement accepted when creating an organization.

4. AI tools

AI steps generate replies based on your instructions and may be inaccurate. You are responsible for reviewing and using AI output, and you agree to use AI tools for your own business purposes rather than as a general-purpose chatbot.

5. Fees, trials and subscriptions

Plans, prices and limits are published on https://merkuva.com and in the panel. Subscriptions renew for the same period unless cancelled; cancellation takes effect at the end of the current period. Exceeding plan limits may pause the related action.

6. Intellectual property

The platform's software, design and brand belong to us. You receive a non-exclusive, non-transferable right to use the platform during the agreement. Content you upload remains yours.

7. Liability

We are not liable for decisions of channel providers, your instructions and content, indirect damages or loss of profit. Our total liability is limited to the fees you paid in the twelve months before the damage, except for intent, gross negligence or where mandatory consumer law applies.

8. Term and termination

The agreement is indefinite. You may close your account at any time. We may suspend or terminate accounts that breach these terms or the law.

9. Changes

We may change these terms. Material changes are announced in advance by email or in the panel and, where needed, re-acceptance is requested.

10. Governing law

Turkish law applies. The courts of İstanbul have jurisdiction, without prejudice to consumers' rights to apply to consumer arbitration committees and consumer courts.
